New York Prepares to Adopt Aerosols as Universal Waste Rule, as Louisiana Begins Internal Discussions

In February 2020, the Environmental Protection Agency (EPA) added aerosols to the federal universal waste list, providing clearer guidelines and less complex requirements for the disposal of aerosols. This eases the regulatory burden faced by retailers while reducing the quantity of aerosols going to municipal solid waste landfills and combustors.

Clean Earth is tracking the status of the rulemaking process within each state. This includes updates on the proposed rule publish dates, public hearing dates, comment periods, meeting notices, and final rule effective dates. As states begin to implement the rule, Clean Earth will continue to share the status of the rulemaking process.  

Anticipated Rulemaking in 2023:

Maryland: The rule is currently being drafted. The proposed publish date, public hearing dates, comment periods, and meeting notices are scheduled for Summer 2023. The final rule is set to go into effect in September 2023.  

New York: The rule is currently complete, with the final rule set to go into effect on July 8, 2023.

Anticipated Rulemaking in 2024:

Kansas: The rule is currently being drafted by reference to the BWM Policy 2017-P2. The proposed rule will be published in Summer 2023. The public hearing dates, comment periods, and meeting notices will take place in Fall 2023. The final rule is set to go into effect in 2024.  

Minnesota: The rule is currently being drafted and added to previously proposed rulemaking: Land-Related Housekeeping Amendments. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in August 2023. The final rule is set to go into effect in February 2024 if no hearing is required. If a hearing is required, the final rule will go into effective in August 2024.  

Missouri: The rule is currently being drafted and in the stakeholder review period. The proposed publish date, public hearing dates, comment periods, and meeting notices will occur in Summer 2023. The final rule is set to go into effect in early 2024.  

Anticipated Rulemaking Not Yet Determined:

Louisiana: The rule is currently undergoing internal discussions. The proposed rule publish date, public hearing dates, comment periods, meeting notices, and final rule effective date have not yet been determined.
