California, Kansas and Missouri Look to Adopt Hazardous Waste Generator Improvement Rule by End of 2023

As it stands, currently 40 states have adopted the EPA’s Hazardous Waste Generator Improvement Rule (including Puerto Rico). Signed on October 28, 2016, this rule has generated impacts including:

  • Less pressure on hazardous waste generators to avoid a higher generator status

  • Allows very small quantity generators to send hazardous waste to a large quantity generator under control of the same person

  • Enhances safety of facilities, employees, and public

  • Streamlines hazardous waste risk communication

  • Ensures emergency management requirements meets current day needs

Clean Earth continues to monitor the rule’s progress as more states look to adopt a final rulemaking.

Anticipated Rulemaking Before January 2023

Washington D.C.: The rule is undergoing legislative review. The final rule is to go into effect in late 2022.

Anticipated Rulemaking After January 2023

California: The rule is currently being drafted focusing only on mandatory provisions. The proposed publish date is scheduled for November 2022. The public hearing dates and comment periods will occur in either December 2022 or January 2023. The final rule is to go into effect in January 2023.

Kansas: The rule is currently being drafted. The proposed publish date, public hearing dates, comment periods and meeting notices are scheduled for Spring 2023. The final rule is to go into effect in late 2023.

Missouri: The rule is currently being drafted and undergoing the Stakeholder Review Period. The proposed publish date, public hearing dates, comment periods and meeting notices are scheduled for Spring 2023. The final rule is to go into effect in late 2023.
