Kansas and Maine Determine the Proposed Publish Date for Hazardous Waste Generator Improvement Rule

When disposed of incorrectly, hazardous waste negatively impacts human health and the environment. The Environmental Protection Agency has put the Hazardous Waste Generator Improvement Rule in place to protect us from these negative effects.

Many states have adopted this rule, but there are a few that have yet to. Clean Earth is actively tracking those states that are moving toward adopting the rule to help businesses with operations in those states remain compliant.

Anticipated Rule Making Before January 2024:

California: The rule is currently being drafted focusing only on mandatory provisions. The proposed publish date is scheduled for early 2023. The public hearing and comments are due in early 2023. The final rule is to go into effect in 2023.

Minnesota: The rule is currently being amended. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in April 2023. The amended rule is to go into effect in 2023.

Anticipated Rule Making After January 2024:

Kansas: The rule is currently being drafted. The proposed publish date is early 2023. The public hearing dates, comment periods and meeting notices are scheduled for Fall 2023. The final rule is to go into effect in 2024.

Maine: The rule is undergoing internal discussions. The proposed publish date is September 2023. The public hearing dates, comment periods and meeting notices are scheduled for Fall 2023. The final rule is to go into effect in 2024.

Nebraska: The rule is undergoing internal discussions. The proposed publish date is Fall 2023. Public hearing dates, comment periods and meeting notices will occur in Summer 2023 for stakeholders and Fall 2023 for the public. The final rule is to go into effect in late 2024.
