Kansas and Nebraska Set to Adopt Hazardous Waste Generator Improvement Rule in 2024

The Environmental Protection Agency (EPA) has been implementing the hazardous waste generator regulatory program for decades. In 2016, the EPA finalized the Hazardous Waste Generator Improvement Rule, which provides more flexibility, improves environmental protection and addresses inconsistencies in the regulations.

States continue to work toward adopting the final Hazardous Waste Generator Improvement Rule to reach compliance. Clean Earth provides monthly updates to help hazardous waste generators stay up to date on the latest regulations and requirements.

Anticipated Rulemaking in 2023:

California: The rule is currently in the public comment period. The proposed rule was published on March 24, 2023. Comments are due on May 8, 2023. The final rule is set to go into effect in 2023. 

Anticipated Rulemaking in 2024:

Kansas: The rule is currently being drafted. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in Fall 2023. The final rule is set to go into effect in 2024.

Nebraska: The rule is currently in the internal discussions period. The proposed publish date, public hearing dates, comment periods and meeting notices are not yet determined. The final rule is set to go into effect in 2024.
