New Hampshire and Rhode Island Set to Adopt Hazardous Waste Generator Improvement Rule in Fall 2024

The implementation of clear regulations for hazardous waste generators can help to mitigate risk and facilitate environmental compliance. The Environmental Protection Agency (EPA) did exactly that when signing the Hazardous Waste Generator Improvements Rule. The rule’s provisions allow hazardous waste generators to avoid the increased burden of a higher generator status when properly managing episodic waste.

Clean Earth is monitoring the progress of regulatory developments within each state. These developments include updates on the proposed rule publish dates, public hearing dates, comment periods, meeting notices, and final rule effective dates.

Anticipated Rulemaking in 2024: 

California: The rule is currently in the post-public comment period. The proposed rule was published on March 24, 2023, with modifications on July 5, 2023. The final rule is set to go into effect in 2024. 

Connecticut: The rule is currently being drafted. The proposed rule, along with hearing dates, comment periods and meeting notices, is expected to be published in 2024. The final rule is set to go into effect in 2024 or 2025. 

New Hampshire: The rule will be issued into two parts. Part 1, Env-Hw300-800, 110, 1200, is complete. Part 2 is undergoing internal discussions. The proposed rule, along with hearing dates, comment periods and meeting notices, is set to be published in the summer of 2024. The final rule is set to go into effect in the fall of 2024. 

Rhode Island: The rule is undergoing internal discussions. The rule is set to be published in the summer of 2024, followed by a comment period. The final rule is set to go into effect in the fall of 2024.

Anticipated Rulemaking in 2025: 

Kansas: Currently, the rule is being drafted in accordance with BWM Policy 2017-P2. The proposed rule, along with hearing dates, comment periods and meeting notices, is set to be published in 2024. The final rule is expected to occur in 2025. In 2022, Kansas signed a policy on August 2, 2017, identifying the less stringent provisions being implemented before the adoption of the rule.

Massachusetts: The rule is undergoing internal discussions. The proposed rule, along with hearing dates, comment periods and meeting notices, is expected to be published in 2024. The final rule is set to go into effect in 2025.

Missouri: The rule is being drafted. The proposed rule is set to be published on August 15, 2024.Currently, the comment period is expected to occur in 2024. The final rule is set to go into effect on February 18, 2025.
