Virginia Adopts Aerosols as Universal Waste Rule, Effective in January

The Environmental Protection Agency began regulating aerosol cans as universal waste in response to the increasing quantity of cans produced each year. These regulations ease regulatory burdens on retailers, promote recycling and reduce the number of discarded aerosol cans that end up in landfills.

Aerosol regulations are enforced in most states, and Clean Earth continues to monitor the status of the remaining states that have yet to fully adopt this rule.

Anticipated Rule Making Before January 2024:

Arkansas: The rule is currently being drafted and undergoing internal review. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in early 2023. The final rule is to go into effect in 2023.

Louisiana: The rule is undergoing internal discussions and is scheduled to go into effect in early 2023. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in early 2023.

Maryland: The rule is currently being drafted and is scheduled to go into effect in September 2023. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in early 2023.

Massachusetts: The rule is currently being drafted and is scheduled to go into effect in 2023. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in early 2023.

Minnesota: The rule is currently being amended. The proposed publish date, public hearing dates, comment periods and meeting notices will occur in April 2023. The amended rule is to go into effect in 2023; the existing rule remains in effect.

Virginia: The rule is currently complete pending publication. The final rule is to go into effect on January 18, 2023.

Anticipated Rule Making After January 2024:

Kansas: The rule is currently being drafted. The proposed publish date is early 2023, and the public hearing dates, comment periods and meeting notices will occur in Fall 2023. The final rule is to go into effect in 2024.

Maine: The rule is undergoing internal discussions. The proposed publish date is September 2023, and the public hearing dates, meeting notices and comment periods will occur in Fall 2023. The final rule is to go into effect in 2024.

Nebraska: The rule is undergoing internal discussions. The proposed publish date is Fall 2023. Public hearing dates, comment periods and meeting notices will occur in Summer 2023 for stakeholders and Fall 2023 for the public. The final rule is to go into effect in late 2024.
