Pharmaceutical Final Rulemaking Status - June 2020

In February of 2019 the EPA's acting administrator's rule was published around the handling of pharmaceutical  hazardous waste. One of the major impacts this rule will have is the safety of our drinking and surface water in its goal to remove contaminants from pharmaceutical disposal

States Where the Rule is in Effect

Alabama, Alaska, Florida, Georgia, Iowa, Kentucky, New Jersey, Pennsylvania, South Dakota, and Virginia

Specific Updates

Arizona published its proposed rule date May 18, 2020 (Stakeholder Outreach/Draft Rules);  On June 9, 2020 the public hearing meetings took place (Stakeholder Outreach/Draft Rules - Comments Accepted During Meeting); Colorado completed its public hearings and effective is planned for late June/early July. Delaware has a proposed rule publish date of July 1st (pending). The District of Columbia's proposed rule date will be published in June or July of 2020 with comment periods and public hearing following 30 days after publication, and a final rule effective date in Fall of 2020. Illinois proposed rule dates as follows 5/12/2020 (Online); 6/12/2020 (Register), the comments will be due 7/27/2020; board meeting 8/6/2020, with a final rule effective date on 8/17/2020. Indiana is now in its post public comment period, public hearing is anticipated in Summer 2020, Nebraska will have a final rule proposed in Summer or Fall of 2020 with a public hearing and comment period in the same time frame with a final rule effective date in late 2020. New York's proposed published rule date will be Summer 2020 (various agencies review); Late 2020 (public review) the formal public comment period will be in late 2020 or early 2021, and a rule effective date in 2021. Ohio has proposed a rule publish date in Summer of 2020 along with its comment period. South Carolina is having public hearings and comment period in Summer 2020 and a final rule effective date in Spring 2021. Vermont's proposal for a rule date is not yet determined along with public hearings and effective dates. Washington is now in its post public comment period. Wisconsin's rulemaking should now be complete (pending publication and effective date), the effective date is set at 8/1/2020.
